Terms and Conditions

Classes

Payments and reservations 

  • All classes must be paid in full before the 5th day of each month.
  • I am not responsible for any extra fees your bank might charge. 

Changes and cancellations 

For group classes:

  • If you can’t assist to a class, this will not be refunded.
  • The classes where one student cannot assist, will be recorded and uploaded to Notion. In this way you will be able to watch it at your own pace. 
  • Only if the whole group agrees and we find a suitable day and time, the class could be rescheduled.

For individual classes:

  • It is possible to reschedule a lesson if students give at least 24 hours’ notice, either via Email or WhatsApp. 
  • In case of emergency, the class can be rescheduled. 
  • An emergency is a last minute, unavoidable meeting or doctor appoinment – please provide proof thereof. 
  • If there is a change or cancellation with less than 24 hours’ notice, the class will be charged
  • If the student does not attend class, the class will be charged. I only wait for 15 minutes
  • If you’re running late, you can let me know via WhatsApp, but I don’t guarantee that we can  have the full class in that case. 
  • If for whatever reason I’m running late, I’ll let you know via WhatsApp and we will recover the time left at a day and time that suits both of us. 

In case I need to make any changes due to sickness, the class will be either reimbured or rescheduled.

Holidays

  • Bank holidays are free.
  • There is one week off at Easter
  • There are two weeks off at Christmas.
  • There are no classes in July and August.

In case I go on holidays at another time of the year, these will be notified in advance. 

Others 

I reserve the right to change the prices of the classes at the start of the school year (September), but I will always let the students know in advance. 

Digital Products

  • Any order placed on jimenaibarra.com implies full and unreserved acceptance of these general conditions of sale.
  • The prices are indicated in euros all taxes included. The price of items can be changed at any time. However, the price applied to an order will be that announced at the time of the order.
  • Payment is due immediately on the date of the order, including for pre-order products. You can pay by credit card. Secure online payment by credit card is made through the company Stripe. The information transmitted is encrypted by software in the rules of the art and cannot be read during transport over the network. Any guarantee as to the security of this system is entirely the responsibility of the company Stripe and cannot be attributed to us.
  • Due to the immediate and digital nature of these products, all purchases are final and non-refundable once access has been granted.
  • Delivery is immediate and online through my platform on systeme.io.
  • All personal data of users is respected and cared for  on this website and your rights are guaranteed, because we comply with the current law: Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights. It also complies with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 regarding the protection of natural persons (RGPD), as well as Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce (LSSICE or LSSI).
  • By adhering to these general conditions of sale, you acknowledge having read our personal data protection policy and consent to our collection and use of this data. By entering your email address on one of our network sites, you will receive emails via the newsletter of JIMENA IBARRA.
  • You can unsubscribe from the Newsletter at any time. You just have to click on the link at the end of my emails. 

Spanish with Stories Membership

1. What is included in the membership

All paid membership plans, whether monthly or yearly, give you access to:

  • The membership platform and its available Spanish-learning content.

  • One live online Spanish class per week during the teaching periods specified below.

  • The membership is designed to provide ongoing access to pre-recorded Spanish lessons and resources, together with a weekly live class.
  • The content available on the platform may be updated, expanded or reorganised from time to time as part of the ongoing development of the membership.

2. Free option

  • There is no free trial period for the paid membership.
  • A free option is available so that you can explore the platform and try some of the content before deciding whether the paid membership is right for you.
  • You can upgrade from the free option to a paid membership at any time using the links provided on the platform.

3. Monthly membership

If you choose the monthly membership:

  • Your membership will renew automatically each month until you cancel it.

  • You will have access to the platform, its available content and the weekly live class for as long as your membership remains active.

  • You may cancel your membership at any time.

  • When you cancel, your membership will remain active until the end of the period that you have already paid for.

  • Your cancellation will take effect on the next scheduled payment date, and no further payments will be taken after that date.

  • Cancelling your membership does not entitle you to a refund for the remaining days of the current paid period.

4. Yearly membership

If you choose the yearly membership:

  • You receive access to the platform, its available content and the weekly live online class for a period of 12 months from the date of purchase.

  • The yearly membership is paid in full at the time of purchase.

  • The yearly membership does not renew automatically. At the end of the 12-month period, your membership will end unless you actively choose to purchase a new membership.

  • If you wish to continue after the 12 months, you may choose between the monthly and yearly membership options available at that time.

  • If you decide to cancel your yearly membership before the end of the 12-month period, no refund will normally be provided for the unused portion of the membership period, without prejudice to any mandatory rights you may have under applicable consumer protection legislation.

5. Live classes and holiday periods

  • The weekly live class is included as part of the membership and is provided during the teaching periods of the membership.
  • No live classes are held during August, the Easter period or the Christmas holiday period. The specific dates of these breaks will be communicated to members in advance.
  • The membership fee does not change as a result of these scheduled holiday periods.
  • If I am unable to hold a particular class for another reason, such as illness, an unavoidable commitment or another unforeseen circumstance, I will inform members as soon as reasonably possible and, where possible, provide an alternative date or another suitable arrangement.
  • If you are unable to attend a live class, you will not normally be entitled to a refund or reduction in your membership fee.
  • Where possible, a recording or alternative learning resource may be provided, but this is not guaranteed unless expressly stated.

6. Access to the platform and content

  • Membership access is personal to the member and may not be shared with, transferred to or used by another person.
  • Your login details must be kept confidential. You may not reproduce, distribute, resell, share or make the membership content available to third parties.
  • The pre-recorded lessons, videos, audio, written materials and other resources provided through the membership are protected by applicable intellectual property laws.
  • Your membership gives you a personal, non-exclusive right to access and use the content for your own Spanish-learning purposes. It does not transfer ownership of the content to you.

7. Changes to membership content

  • The membership is an ongoing learning platform, and content may be added, removed, updated or reorganised over time.
  • I may make reasonable changes to the content, structure, teaching materials or platform in order to improve the membership or keep it up to date.
  • I will not make changes that substantially reduce the core benefits of a paid membership without providing appropriate notice and, where required by applicable law, any applicable rights or remedies.

8. Technical problems and platform access

  • Every reasonable effort will be made to keep the platform and its content available and functioning properly.
  • Occasional interruptions may occur because of maintenance, technical problems, internet or hosting issues, or circumstances outside my reasonable control.
  • Where a significant technical problem affects access to the membership, reasonable steps will be taken to restore access as soon as possible.

9. Payments

  • Payments are processed through the payment provider Stripe, made available at the time of purchase.
  • For monthly memberships, you authorise the applicable payment provider to charge the membership fee on each scheduled renewal date until you cancel your membership.
  • The yearly membership is paid in full at the time of purchase and does not renew automatically.
  • If a payment fails, access to the paid membership may be suspended until the outstanding payment is successfully completed.

10. Cancellation and consumer rights

  • Nothing in these Terms and Conditions is intended to exclude, restrict or limit any mandatory rights that consumers have under applicable consumer protection legislation.
  • Where applicable, consumers may have a statutory right of withdrawal in relation to services or digital content. Where the law permits this right to be excluded or lost once access to digital content begins, the necessary information and express consent will be obtained during the purchase process.
  • Our cancellation and refund policies apply without prejudice to any mandatory consumer rights or legal remedies that may apply.

11. No guarantee of learning results

  • The membership provides access to educational materials and live teaching designed to support your Spanish learning.
  • However, individual learning results depend on many factors, including participation, practice, previous knowledge and individual circumstances. No specific level of Spanish, fluency or learning outcome is guaranteed.

12. Changes to these Terms

  • These Terms and Conditions may be updated from time to time to reflect changes to the membership, applicable legislation or the way the service is provided.
  • Where a change materially affects your existing membership, you will be informed in accordance with applicable law.

13. Acceptance of these Terms

  • By purchasing a paid membership, you confirm that you have read and accepted these Terms and Conditions.

Immersive Activities

1. The activity

Each immersive activity consists of three parts:

  1. A preparation class, held online before the activity.

  2. The immersive activity, held in person.

  3. A post-activity class, held online after the activity.

The price covers the complete experience, including all three components.

Participants are therefore not entitled to a discount or partial refund if they choose not to attend any one or more of these components.

 

2. Cancellation by the participant

If you need to cancel your participation:

  • 14 or more days before the activity: you will receive a 100% refund.

  • 7–13 days before the activity: you will receive a 50% refund.

  • Less than 7 days before the activity: the booking is normally non-refundable, except in the exceptional circumstances described below.

Cancellation requests must be made by email or through the contact method specified at the time of booking. The applicable cancellation period is determined by the date and time on which your cancellation request is received.

Failure to attend the activity without cancelling in advance will be treated as a cancellation made less than 7 days before the activity and will normally not be refundable.

 

3. Exceptional circumstances

If you are unable to attend less than 7 days before the activity because of an exceptional circumstance that is genuinely beyond your reasonable control, you may request a full refund.

Examples of circumstances that may qualify include:

  • Your own illness or a medical appointment that cannot reasonably be rescheduled, particularly where it takes place within the public healthcare system.

  • The illness of your child or a medical appointment required because your child is ill.

  • An unavoidable work commitment, such as an unexpected business trip, mandatory work meeting or other work obligation that could not reasonably have been anticipated or avoided.

  • The death of a close relative.

  • A serious accident or other unforeseen event directly affecting you or an immediate family member.

  • An urgent family emergency requiring your presence.

  • A significant transport disruption or cancellation that makes it genuinely impossible or unreasonable for you to attend, where the disruption is outside your control.

This list is not exhaustive. Each request will be considered in light of the circumstances and the evidence reasonably available.

Where appropriate, reasonable supporting documentation may be requested. Any documentation provided will be treated confidentially and only used for the purpose of assessing the cancellation request.

 

4. Late arrival and non-attendance

  • Participants are responsible for arriving at the designated meeting point at the stated time.
  • If you arrive late and are unable to join the activity as a result, this will normally be treated as non-attendance and will not entitle you to a refund.
  • If you arrive late, but are able to join the activity, it’ll count as attendance.
  • If you are unable to attend the activity but have attended the preparation class, no partial refund will be provided unless otherwise agreed.

5. Changes to the activity

  • I reserve the right to make reasonable changes to the itinerary, venue, timing or specific elements of an activity when necessary due to circumstances outside my reasonable control, including weather conditions, venue availability, transport disruptions or changes imposed by third-party providers.
  • Where a significant change is necessary, participants will be informed as soon as reasonably possible and, where appropriate, offered an alternative arrangement.

6. Cancellation or postponement by the organiser

  • In exceptional circumstances, Jimena may need to cancel or postpone an activity, for example due to illness, insufficient participation, severe weather, venue problems or circumstances beyond Jimena’s reasonable control.
  • If Jimena cancels an activity and no suitable alternative date or arrangement can be agreed, participants will receive a full refund of the amount paid for the affected activity.
  • No additional compensation will be payable for costs incurred independently by participants, such as travel, accommodation or other expenses, unless required by applicable law.

7. Food, allergies and dietary requirements

  • Where food or drinks form part of an activity, participants are responsible for informing the organiser of any relevant allergies, intolerances or dietary requirements before the activity.
  • The organiser will communicate relevant requirements to third-party venues where reasonably possible. However, Jimena cannot guarantee an allergen-free environment where food is prepared or served by a third party, but will make her best to accomodate everyone.
  • Participants should inform Jimena of any dietary requirement at the time of booking or as soon as they become aware of it.

8. Personal belongings and responsibility

  • Participants are responsible for their own personal belongings and for taking reasonable care of their own safety during the activity.
  • Participants must follow reasonable instructions given by the organiser or by venues, guides or other third-party providers involved in the activity.
  • Nothing in these Terms and Conditions excludes or limits any liability that cannot legally be excluded or limited under applicable law.

9. Behaviour

  • Participants are expected to behave respectfully towards the organiser, other participants, staff and third-party providers.
  • The organiser reserves the right to refuse participation or ask a participant to leave an activity where their behaviour is abusive, threatening, seriously disruptive, discriminatory or creates a risk to themselves or others.
  • Where a participant is removed from an activity because of their own inappropriate behaviour, they will not normally be entitled to a refund, without prejudice to any rights they may have under applicable law.

10. Consumer rights

  • Nothing in these Terms and Conditions is intended to exclude, restrict or limit any mandatory rights that consumers have under applicable consumer protection legislation.
  • These immersive activities are leisure services scheduled for a specific date or period. Where the applicable legal requirements are met, the statutory right of withdrawal does not apply to such services under the relevant exception provided by Spanish consumer legislation.
  • The cancellation and refund policy set out above is offered in addition to, and without prejudice to, any mandatory consumer rights or legal remedies that may apply.

11. Acceptance of these Terms

By booking an immersive activity, the participant confirms that they have read and accepted these Terms and Conditions.
